- Heather Aby was successful in recently obtaining the dismissal, with prejudice, of two Petitions to Controvert in Mississippi Workman’s Compensation cases. (03.26.12)
- Mark Carlson and Christy Malatesta recently obtained summary judgment in the United States District Court for the Southern District of Mississippi, Jackson Division. The case involved placement of a BFI waste container which plaintiff alleged blocked the view of a driver crossing the tracks and hitting a southbound Illinois Central Railroad train. The suit brought by the conductor was dismissed by the Court on the basis that the waste container did not block the vision of a driver crossing the tracks, but even in the event it did, it was not the proximate cause of the conductor’s claims for emotional damages for having to investigate the accident.
- Mark Carlson and Christy Malatesta recently obtained summary judgment in Ricky Palermo v LifeLink Tissue Bank LLC, Hinds Co. Circuit Court. The case involved the implantation of a tibialis tendon, supplied by LifeLink, in plaintiff’s knee which subsequently became infected. Since the plaintiff could not prove through discovery or its experts that the tendon allograft was the source of the infection, the Court granted LifeLink’s motion for summary judgment. The Court also determined that the plaintiff could not sustain his burden under a theory of strict tort liability.
- Lynn Patton Thompson recently secured 2 wins for client W.B. Construction and Sons, Inc. out of Beaumont and Austin, Texas before the General Accountability Office (GAO) in Washington, DC. The protests involved separate procurements combined in excess of $35 million dollars and Ms. Thompson prevailed on both.
- Ryan Perkins and Christy Malatesta recently won Summary Judgment for their client, Supermarket Operations d/b/a Piggly Wiggly in an Adams County six-figure demand lawsuit filed by a plaintiff customer who claimed to have been injured after slipping on a grape inside the store. Defense counsel also filed a Motion to Strike Plaintiff’s Response, including an Affidavit of an expert who attempted to create an issue of material fact by pointing to the possibility of constructive notice on behalf of the Piggly Wiggly based upon a gap in time between the store’s documented aisle checks. At a hearing on the merits and after oral argument by Mr. Perkins, the Adams County Judge found in favor of the defendant, granting both the Motion to Strike and the Motion for Summary Judgment, resulting in a Final Dismissal with Prejudice as to all claims against the defendant supermarket.
